What is an H-Visa in USA

H-1B visas allow companies to hire foreign professionals for specialty occupations for up to 6 years. Since immigration in the United States is complex, your first step in obtaining a H1b sponsorship should be a visit to the legal team. You should ensure all the important documents are properly filled out.

In order to sponsor an H1B, an employer must have:

  • The position requires knowledge gained through an higher levels educational institution, or special training.
  • The position requires at lease a B.A. degree.
  • A completed degree in a field directly related to the position, or equivalent experience in the field.
  • The employer is willing to pay a minimum salary equal to the prevailing wage.

Here are some benefits for having an H-1b Visa:

  • Your immediate family can stay with you as long as you maintain your H-1B status. Family can attend school.
  • You can freely travel in and out of the U.S. (with valid visa)
  • H-1B is valid for 3 years, with one 3 year extension (total of 6 years). This may be further extended if the holder has begun the Green Card process.

H-1b extension & permanent residency:

H-1B visas are limited to 3 years, and up to 6 years after extension. It is important to apply for the extension prior to the dates specified by USCIS. Clients are allowed to stay after the cumulative 6 year period of the H-1B and extension if you apply for permanent residency (Green Card) while holding an H-1B visa. It is important that client apply for the Green Card by the end of year 2 of their extension.
